NASHVILLE ATTORNEY CENSURED
On January 12, 2007, Matthew F. Mayo of Nashville, Tennessee received a Public Censure from the
Board of Professional Responsibility based on two (2) complaints. Mayo was given notice of the censure and
did not request a hearing.
The first complaint concerned Mayoâs representation of the client in Juvenile Court. Mayo was retained
in August, 2004, and filed an Amended Petition for Visitation on behalf of his client. Mayo has been
unsuccessful in serving the mother of the child with the Petition. Mayo also failed to respond to his clientâs
correspondence requesting information about the case. Mayoâs neglect and failure to communicate with his
client violates Rules 1.3; 3.2; 1.4 and 8.4(a)(d) of the Tennessee Rules of Professional Conduct.
In the second complaint, a client retained Mayo for a divorce on September 8, 2003. Mayo filed the
clientâs divorce on October 8, 2003, however, the Final Decree of Divorce was not entered until July 13, 2006.
In mitigation, the client was incarcerated from approximately August, 2004 until December, 2005. Mayoâs
neglect of the clientâs divorce and failure to respond to the clientâs inquiries about her case violates Rules 1.3;
1.4; 3.2 and 8.4 of the Tennessee Rules of Professional Conduct.
The Censure declares Mayoâs actions to be improper but does not limit his right to practice law.
