NASHVILLE LAWYER CENSURED
On February 19, 2008, David H. Hornik, of Nashville, Tennessee, received a public censure from
the Board of Professional Responsibility. Hornik was given notice of the censure and did not request a hearing.
Hornik represented a client in a workerâs compensation case which was dismissed for Hornikâs failure to
prosecute. After the client filed her complaint with the Board of Professional Responsibility, Hornik
acknowledged his malpractice to the Board and advised that he had notified his professional liability carrier of
the probable claim. Hornik failed to respond to the Boardâs requests for information and his clientâs requests
for information. Hornikâs neglect and failure to communicate with his client and the Board violates Rules 1.3;
1.4; 8.1(b) and 8.4 of the Tennessee Rules of Professional Conduct. The censure declares Hornikâs actions to
be unethical but does not limit his right to practice law.
