MEMPHIS LAWYER PUBLICLY CENSURED
Charles R. Curbo, of Memphis, was publicly censured by the Board of Professional
Responsibility on September 25, 2002. The censure was issued by the Board pursuant to Rule 9,
Section 8 of the Rules of the Te nnessee Supreme Court. Curbo did not request a hearing on the
matter.
In one complaint filed against Mr. Curbo, the Board found that he grossly neglected a clientâs
case then pending with the Tennessee Court of Criminal Appeals. Curbo failed to file the trial
transcript some six months after he filed the clientâs notice of appeal in July of 2001, and he did
not respond to the Court of Criminal Appealsâ January 11, 2002 Order requiring him to file the
transcript or other pleading explaining the status of the appeal within 15 days. Curbo was
relieved as counsel on March 1, and failed to appear for his own show cause hearing on
March 12, 2002 as ordered. On March 13, the Court of Criminal Appeals adjudged him to be in
willful contempt and fined him $50.00.
The Board concluded that Curbo had disrespected the Court and that he had habitually
violated rules of procedure and orders of the Court. Given Mr. Curboâs disclosure to the Board of
unspecified impairments which have disaffected his practice of law, the Board ordered Curbo
within the censure to undergo assessment by, and entry into a peer assistance contract with the
Tennessee Lawyers Assistance Program (TLAP), if recommended by this organization.
