ORDER OF ENFORCEMENT
This matter is before the Court upon a Petition for Discipline, Docket No. 2002â
1301-9-LC filed by the Board of Professional Responsibility (the Board) against William
Penn (Respondent) on March 15, 2002; upon Respondentâs Response to the Petition ï¬led
May 2, 2002; upon the Boardâs Supplemental Petition for Discipline ï¬led November 6,
2003; upon Respondentâs Response tiled December 1, 2003; upon the Boardâs Second
Supplemental Petition for Discipline ï¬led January 7, 2004; upon Respondentâs Response
to Second Supplemental Petition for Discipline filed January 30, 2004; upon the Boardâs
Petition for Discipline, Docket No. 2002â1306w9~LC tiled against Respondent and
Patricia Penn; upon Respondent and Patricia Pennâs Response to Petition for Discipline
ï¬led April 30, 2002', upon the Boardâs Supplemental Petition for Discipline ï¬led January
21, 2003 and Respondent and Patricia Pennâs Response ï¬led February 10, 2003; upon a
hearing on April 22 and 23, 2008; upon Order of the Hearing Panel ï¬led June 9, 2008;
upon the Hearing Panelâs Order denying Respondentâs Motion to Alter or Amend ï¬led
September 9, 2008; upon consideration by the Board on June 13, 2008; upon the
Respondentâs Notice of Appeal tiled October 9, 2008; upon the Circuit Courtâs Judgmont
and Memorandum ï¬led December 1, 2009; upon the Circuit Courtâs Order denying
Respondentâs Motion to Supplement the Record and Motion to Alter or Amend tiled
March 16, 2010; upon Respondentâs Notice of Appeal ï¬led June 3, 2010; upon the
Boardâs Motion to Dismiss ï¬led February 9, 2011; upon this Courtâs Order ï¬led
April 25, 2011 and this Courtâs Order ï¬led April 26, 2011 and upon the entire record in
ï¬lls cause.
From all of which, the Court approves the Order of the Hearing Panel and adopts
the Order of the Hearing Panel as the Courtâs Order.
It is, therefore, ORDERED, ADJUDGED and DECREED by the Court that:
1. The Respondent, Wiiliam B. Penn, is suspended for three years, with all
time suspended except for tweive (12) months, upon the condition that prior to
reinstatement, Mr, Penn pay restitution in the total amount of $36,040 and pay the costs
of the disciplinary proceeding in the amount of $9,324.50.
2. The Board shall cause notice of this discipline to be pubiished as required
by Supreme Court Rule 9, Section 18.10.
