ORDER OF ENFORCEMENT

This matter is before the Court upon a Petition for Discipline, Docket No. 2002—
1301-9-LC filed by the Board of Professional Responsibility (the Board) against William
Penn (Respondent) on March 15, 2002; upon Respondent’s Response to the Petition filed
May 2, 2002; upon the Board’s Supplemental Petition for Discipline filed November 6,
2003; upon Respondent’s Response tiled December 1, 2003; upon the Board’s Second
Supplemental Petition for Discipline filed January 7, 2004; upon Respondent’s Response
to Second Supplemental Petition for Discipline filed January 30, 2004; upon the Board’s
Petition for Discipline, Docket No. 2002—1306w9~LC tiled against Respondent and
Patricia Penn; upon Respondent and Patricia Penn’s Response to Petition for Discipline
filed April 30, 2002', upon the Board’s Supplemental Petition for Discipline filed January
21, 2003 and Respondent and Patricia Penn’s Response filed February 10, 2003; upon a
hearing on April 22 and 23, 2008; upon Order of the Hearing Panel filed June 9, 2008;
upon the Hearing Panel’s Order denying Respondent’s Motion to Alter or Amend filed
September 9, 2008; upon consideration by the Board on June 13, 2008; upon the
Respondent’s Notice of Appeal tiled October 9, 2008; upon the Circuit Court’s Judgmont
and Memorandum filed December 1, 2009; upon the Circuit Court’s Order denying
Respondent’s Motion to Supplement the Record and Motion to Alter or Amend tiled
March 16, 2010; upon Respondent’s Notice of Appeal filed June 3, 2010; upon the
Board’s Motion to Dismiss filed February 9, 2011; upon this Court’s Order filed
April 25, 2011 and this Court’s Order filed April 26, 2011 and upon the entire record in
fills cause.

From all of which, the Court approves the Order of the Hearing Panel and adopts
the Order of the Hearing Panel as the Court’s Order.

It is, therefore, ORDERED, ADJUDGED and DECREED by the Court that:

1. The Respondent, Wiiliam B. Penn, is suspended for three years, with all
time suspended except for tweive (12) months, upon the condition that prior to
reinstatement, Mr, Penn pay restitution in the total amount of $36,040 and pay the costs
of the disciplinary proceeding in the amount of $9,324.50.

2. The Board shall cause notice of this discipline to be pubiished as required
by Supreme Court Rule 9, Section 18.10.
