The above complaint: was ï¬led against Jerry Dell Holmes, #16150, an attorney licensed
to practice law in Tennessee, alleging certain. acts of misconduct. Pursuant to Tenn. Sup. Ct, R.
9, the Board ofiârofessional Responsibility considered these matters at its meeting on September
9, 2016.
> Mr. Holmes operates a title and escrow company. Mr. Holmes did not maintain adequate
bookkeeping procedures and failed to properly train .and7superviâse nonlawyer staff. As a result,
V at least twenty overdratts occurred on Mr. Holmcsâ trust accounts over a- six month period.
By these acts, Jerry Dell Holmes has violated Rules of Professional Conduct
1.15
(safekeeping property and funds) and 5.3 (responsibilities regarding nonlawyer
assistants), and is
hereby Publicly Censored for these violations.
