DAYTON LAWYER CENSURED
On October 10, 2008, John Arnold Fitzgerald, of Dayton, Tennessee, received a Public Censure from the
Board of Professional Responsibility of the Tennessee Supreme Court.
The Respondent violated the Rules of Professional Conduct by preparing a civil complaint which was
filed against his former client in a matter which was substantially related to some of the issues in a case in
which the Respondent had previously represented the same former client. The acts of John Arnold Fitzgerald
violated Rules of Professional Conduct 1.6, Confidentiality; 1.7, Conflict of Interest; and 1.9, Conflict of
Interest: Former Client.
For these violations, the Board of Professional Responsibility of the Supreme Court of Tennessee
publicly censured John Arnold Fitzgerald. A Public Censure is a rebuke and warning to the attorney, but it does
not affect the attorneyâs ability to practice law.
