LAW LICENSE OF NASHVILLE ATTORNEY SUSPENDED
On April 11, 2008, the Supreme Court of Tennessee entered an Order suspending the law license of
Rodney M. Phelps for a period of four (4) years.
The Board of Professional Responsibility filed a Petition to Revoke Probation against Phelps pursuant to
Section 8.5 of Rule 9, Rules of the Supreme Court. Phelps submitted a Conditional Guilty Plea agreeing to a
four (4) year suspension for Phelpsâ violation of probation, which had been previously imposed by the Supreme
Courtâs Order, filed December 21, 2006.
Section 18 of Rule 9, Rules of the Supreme Court, requires Phelps to notify by registered and certified
mail all clients he represents in pending matters; all co-counsel and opposing counsel of the Supreme Courtâs
Order suspending him. Section 18 also requires Phelps to deliver to all clients any papers or property to which
they are entitled.
This disciplinary matter was held pursuant to Supreme Court Rules 8 and 9. In Tennessee, suspended
lawyers may, after the passage of their suspension, apply for reinstatement of their law licenses. To be
reinstated, lawyers must carry their burden of proof by clear and convincing evidence and show that the
reinstatement will not be detrimental to the integrity and standing of the Bar or administration of justice or
subversive to the public interest.
