NASHVILLE ATTORNEY CENSURED

On February 9, 2007, the Board of Professional Responsibility publicly censured attorney W.
Allen Barrett. Barrett was given notice of the censure and did not request a hearing.

A client retained Barrett to handle a child support case. Barrett appeared on behalf of the client
at a hearing on June 23, 2005 at which time the Court ruled that the client was entitled to an upward deviation
of child support. The client states when she did not receive her increased child support, she began leaving
messages for Barrett which Barrett failed to return. Barrett admits failing to timely file an Order in this case.
After the client filed the complaint with the Board of Professional Responsibility, Barrett submitted an Order
reflecting the client’s increased child support which was entered October 31, 2006. Barrett’s neglect to insure
that an Order was entered reflecting his client’s increased child support and Barrett’s failure to be responsive to
his client’s inquiries violates Rules 1.3; 1.4; 3.2 and 8.4(a)(d) of the Tennessee Rules of Professional Conduct.
The censure declares Barrett’s actions to be improper ethical conduct, but does not restrict Barrett’s right to
practice law.
