The above complaint was filed against Ramsdale O’DeNeal, #013367, an attorney licensed

to practice law in Tennessee, alleging certain acts of misconduct. Pursuant to Tenn. Sup. Ct. R. 9,

the Board of Professional Responsibility considered this matter at its meeting on September 8,

2023.

Mr. O’DeNeal represented a client in a criminal matter for which there was a written fee

agreement for a flat fee. The client paid the fee. The client agreed to accept a plea on the criminal

charges, and just prior to the date of the hearing to accept the plea, Mr. O’DeNeal requested the

client pay an additional $1,000 fee. Mr. O’DeNeal did not advise the client to seek legal advice,

and he did not receive informed consent to change the fee. The client paid the additional fee. In

the course of the disciplinary investigation, Mr. O’DeNeal refunded to the client the $1,000

additional fee.

By the aforementioned acts, Ramsdale O’DeNeal, is in violation of Rules of Professional

Conduct 1.5 (fees) and 1.8 (conflict of interest: specific rules) and is hereby Publicly Censured for

these violations.
