SEVIER COUNTY ATTORNEY PUBLICLY CENSURED
Joe G. Bagwell, a Sevier County attorney, was publicly censured by the
Tennessee Supreme Court on October 13, 2005.
Disciplinary Counsel, acting on authority of the Board of Professional
Responsibility, filed a Petition for Discipline against Bagwell. Pursuant to Section 16 of
Supreme Court Rule 9, Bagwell submitted a Conditional Guilty Plea in exchange for a stated
form of discipline. He was found guilty of failing to adequately supervise his non-lawyer
assistants and failing to keep adequate escrow records.
Bagwellâs actions violate Rules 5.1; 1.15 and 8.4(a)(d) of the Tennessee Rules of
Professional Conduct.
The Order also specified that Bagwell was to attend the Board of Professional
Responsibilityâs Ethics Workshop and shall reimburse the Board of Professional Responsibility
for costs and expenses of the disciplinary proceeding.
The imposition of this censure declares Bagwellâs actions to be improper ethical
conduct, but does not limit his right to practice law.
