KNOXVILLE LAWYER SUSPENDED
On March 31, 2014, the Tennessee Supreme Court suspended Roger David Hyman, of Knoxville, from
the practice of law for six (6) months.
The Board of Professional Responsibility ï¬led a petition for discipline against Mr. Hyman Containing
two (2) complaints of disciplinary misconduct. A Hearing Panel determined that Mr. Hyman communicated
with a person who was represented by counsel, threatened a litigant, ï¬led a lien against a litigant that was later
declared void, failed to appear at a hearing, and failed to timely pay sanctions required by a court order. Mr.
Hyman appealed the decision of the Hearing Panel. The Hearing Panelâs decision was afï¬rmed by Knox
County Circuit Court and the Tennessee Supreme Court.
Mr. I-Iymanâs actions violate the following Rules of Professional Conduct: 3.], Meritorious Claims and
Contentions; 3.4, Fairness to Opposing Party and Counsel; 3.5(e), Impartiality and Decorum of the Tribunal;
4.2, Communication with a Person Represented by Counsel; 4.4(a), Respect for the Rights of Third Persons;
and 8.4(a) and (d), Misconduct.
Mr. Hyman must comply with the requirements of Tennessee Supreme Court Rule 9, Section 18 and 19
regarding the responsibilities of suspended attorneys.
