SUlâREME COURT OF TENNESSEE
IN RE: THOMAS ANDRE DAVIDSON, BPRNO. 15173 FILE NO. 345 07-4-BM
Respondent, an attorney licensed '
to practice law in Tennessee
(Marshall County)
â PUBLIC CBNSURE
The above complaint was ï¬led against Theinas Andie Davidson, an attorney licensed to
practice law in Tennessee, alleging ceitain acts of misconduct. Pursuant to Tenn. Sup. Ct. R. 9,
the Board of Professional Responsibility considered these matters at its meeting on June 22,
2012.
In the representation of an estate client, Respondent failed to review a . prenuptial
agreement which signiï¬cantly impacted the estate. After-the client died, Respondent tore up the
third codicï¬ to the will, because the client had previously asked him to do so. Respondent kept a
copy of the third-codicil. He submitted the will and ï¬rst two codicils to probate without
informing the court of the-third codicil. He informed his clientâs wife that the third codioil had
been revoked. He later attended a hearing on the estate and did not inform the court of the third
codicii.
Respondent violated miles in effect at the time of his actions by failing to act diligently
and competently in advising his client about his estate without reviewing the terms of a
prenuptial agreement, 'by making misrepresentations to the court, and by making a
misrepresentation to the vote.
