ORDER TO TRANSFER TO DISABILITY INACTIVE STATUS
This matter is before the Court upon a petition to transfer John T. Milburn Rogers
to disability inactive status filed by the Tennessee Board of Professional Responsibility
pursuant to Tenn. Sup. Ct. R. 9, § 27.4.
Upon due consideration of documentation from Mr. Rogersâ medical care provider
submitted by Petitionerâs attorney, Ann C. Short, and the Answer of the Board of
Professional Responsibility, the Court concludes that John T. Milburn Rogers is currently
incapacitated from continuing the practice of law and defending himself against
disciplinary proceedings.
IT IS, THEREFORE, CONSIDERED, ORDERED, ADJUDGED AND
DECREED BY THE COURT THAT:
1. The law license of John T. Milburn Rogers shall be transferred to disability
inactive status for an indefinite period of time and until further orders of the Supreme
Court.
2. Disciplinary proceedings are suspended indefinitely until such time as Mr.
Rogers is removed from disability inactive status.
3. Mr. Rogers shall be allowed to petition for reinstatement to active status
pursuant to Tenn. Sup. Ct. R. 9, § 27.7.
4. The Board shall publish notice of this transfer pursuant to Tenn. Sup. Ct. R.
9, §§ 27.5 and 28.11.
5. Pursuant to Tenn. Sup. Ct. R. 9, § 32.4, documents other than this Order
relating to Mr. Rogersâ disability proceeding shall not be public records and shall be kept
confidential.
