PUBLIC CENSURE
The above complaints were ï¬led against Brennan Patrick Lenihan #022165, an attorney
licensed to practice law in Tennessee, alleging certain acts of misconduct. Pursuant to Tenn. Sup.
Ct. R. 9, the Board of Professional Responsibility considered these matters at its meeting on June
8, 2018. â
â Mr. Lenihan has engaged a pattern of neglecting client matters. In the ï¬rst case, Mr.
Lenihan ignored his clientâs attempts to obtain information about their case as well as requests
' from the Consumer Assistance Program during this time period. In the second case, Mr. Lenihan ,
allowed deadlines that were important to his clients to pass, he did not provide them with draft
pleadings as they requested, and he did not reply to a number of their text messages inquiring as
to the status of the matter. Similarly, in the third case, Mr. Lenihan did not complete his clientâs
amendment to a custody order, he ignored her numerous attempts to communicate with him for
several months, including her request for her ï¬le and a refund of feesâpaid, and he ignored inquiries
from the Consumer Assistance Program as well. In addition, Mr. Lenihan failed to respond timely
to a disciplinary complaint.
By the aforementioned acts, Brennan Patrick Lenihan has violated Rules of Professional
Conduct 1.2 (Scope of Representation), 1.3 (Diligence), 1.4 (Communication), 1.5 (Unreasonable
