SUPREME COURT ISSUES ORDER ON NASHVILLE LAWYERâS
REINSTATEMENT PETITON
Neil McAlpin, Jr., a Nashville lawyer, was suspended from the practice of law in 1991
for one year and until reinstated by the Supreme Court after a hearing. McAlpin did not petition
the Court for reinstatement until 2002.
The petition was heard by a hearing panel of the Board of Professional Responsibility.
The hearing panel recommended that McAlpin be reinstated only after passing the state bar
examination and payment of costs. The hearing panel held that the petitioner had not proved by
clear and convincing evidence that he has the competency and learning in law required for
admission to the bar. Neither party appealed the judgment of the hearing panel.
The Supreme Court ordered on November 2, 2004, that the petition for reinstatement be
taken under advisement pending evidence that petitioner has passed the essay and multi- state
portions of the state bar examination and paid the costs of the proceeding. The Supreme Court
will allow the petitioner to request reconsideration upon completion of the conditions for
reinstatement. McAlpin shall remain suspended from the practice of law until further order of
the Court.
