PUBLIC CENSURE

The above complaints were filed against Jason Lee Holly, #024279, an attorney licensed
to practice law in Tennessee, alleging certain acts of misconduct. Pursuant to Tenn. Sup. Ct. R. 9,
the Board of Professional Responsibility considered these matters at its meeting on December 13,
2024.
Mr. Holly represented a client in a custody case; another client in a breach of contract case;
and a third client in a criminal case. In all three cases, Mr. Holly failed to take proper action on
behalf of his clients, failed to communicate with his clients, and failed to make reasonable efforts
to expedite litigation in each of his clientâs cases. In all three cases, Mr. Holly failed to respond to
requests for information from Disciplinary Counsel. Additionally, the Respondent did not refund
fees to any of his three clients.
Mr. Holly was temporarily suspended from the practice of law on October 27, 2024,
pursuant to Section 12.3 of Rule 9 for failing to respond to three disciplinary complaints. Due to
Respondentâs suspension on October 27, 2024, he was required pursuant to Tennessee Supreme
Court Rule 9, Section 28, to notify all clients by certified mail of the suspension no later than 10
days after the effective date of the order and he was required to deliver all clients any papers or
other property to which they are entitled in accordance with Rule 9 Section 28.5. Mr. Holly
knowingly failed to comply with a court order and knowingly disobeyed his obligations under the
rules of the tribunal by failing to obey the court order.
By these acts, Mr. Holly has violated Rules of Professional Conduct 1.1 (competence); 1.3
(diligence); 1.4 (communication); 1.5 (fees); 1.15 (safekeeping property and funds); 3.2
(expediting litigation); 3.4 (fairness to opposing party and counsel); 8.1 (bar admission and
disciplinary matters); and 8.4 (misconduct) and is hereby Publicly Censured for these violations.
Additionally, as a condition of the Public Censure, Mr. Holly shall refund $2500 in attorney fees
to Complainant Larry Cater Jr., $2500 in attorney fees to Complainant Elizabeth Cox, and $500 in
attorney fees to Complainant James Campbell within 60 days of issuance of this Public Censure.
