BPR No. 9572, an attorney licensed
to practice law in Tennessee
(Monroe County)
PUBLIC CENSURE
The above complaint was filed against Barry Keith Maxwell, an attorney licensed to practice law in
Tennessee, alleging certain acts of misconduct. Pursuant to Tenn. Sup. Ct. R. 9, the Board of Professional
Responsibility considered this matter at its meeting on December 8, 2017.
In August 2017, Mr. Maxwell was administratively suspended from the practice of law and to date his
license has not been reinstated. After Mr. Maxwellâs suspension, he improperly commingled personal funds
into his client trust account and improperly utilized the account for his own use and benefit by using the funds
to pay his personal expenses. In mitigation, Mr. Maxwell no longer held client funds in the account when be
deposited his personal funds therein.
By these acts, Barry Keith Maxwell has violated Rule of Professional Conduct 1.15 (safekeeping
property), and is hereby Publicly Censured for these violations.
