MEMPHIS ATTORNEY PUBLICLY CENSURED

Memphis attorney Martin H. Aussenberg was publicly censured by the Board of
Professional Responsibility on December 19, 2003. Aussenberg was admitted to
practice in the 17th Circuit Court District of Mississippi, pro hoc vice by association with
local Mississippi counsel in a civil case involving a small corporation. Aussenberg was
held in direct contempt by the Circuit Court of Desota County, Mississippi for failing to
follow an order of the court to attend a hearing that was held by the court after the
corporation had filed a bankruptcy petition. By his actions Aussenberg violated DR 1-
102(A)(1)(5) and DR 7-106(A) of the Code of Professional Responsibility. The censure
declares Aussenberg’s actions to be improper but does not limit his right to practice law.
