MEMPHIS ATTORNEY CENSURED
On March 17, 2008, pursuant to Rule 9, Rules of the Tennessee Supreme Court, the Board of
Professional Responsibility issued a Public Censure as to Respondent Richard Brian Fields, who practices law
in Memphis. Mr. Fields did not request a hearing as to this censure and therefore the censure became final.
The censure was based on two complaints. In the first complaint, Mr. Fields informed the Court that he
would dismiss a case but failed to do so as promised. This resulted in a show cause Order. In the same matter,
he failed to inform his client that he was dismissing the case and made misrepresentations to his client about the
disposition. Finally, he neglected to provide the file to his client until the disciplinary complaint was filed. In
the second complaint, Mr. Fields neglected a case and failed to respond to his client in a regular and timely
manner. Further, he failed to withdraw at the clientâs request and failed to provide the file to the client until the
disciplinary complaint was filed.
Respondentâs actions thereby violated RPC 1.3 (diligence on behalf of clients), 1.4 (adequate attorney-
client communications), 1.15 (returning clientâs property – his file) and 8.4 (misconduct - conduct prejudicial to
the administration of justice) of the Rules of Professional Conduct (Supreme Court Rule 8).
For these violations, the Board of Professional Responsibility publicly censures Richard Fields. A
public censure is a rebuke and warning to the attorney, but it does not affect the attorneyâs right to practice law.
