MEMPHIS ATTORNEY DISBARRED

On July 23, 2004, the Supreme Court of Tennessee entered an order disbarring attorney
Robert C. Rosenbush.

On March 21, 2002, the Board of Professional Responsibility filed a petition for discipline
against Rosenbush. On October 4, 2002, the Board filed a supplemental petition for discipline
against Rosenbush. On March 26, 2003, the Board of Professional Responsibility filed a second
supplemental petition for discipline against Rosenbush. On June 25, 2003, a third supplemental
petition for discipline was filed by the Board against Rosenbush. Rosenbush failed to answer the
petition and supplemental petitions, and pursuant to the Board’s motions for default, orders
granting defaults against Rosenbush were entered by the hearing panel. On June 14, 2004, a
hearing panel entered its order recommending the following:

1. Rosenbush be disbarred; and
2. Rosenbush make full restitution to four former clients;
3. Rosenbush turn over any client files or materials to clients within 5 days from the
date of the order;
4. Rosenbush pay costs of the proceeding.

On July 23, 2004, the Supreme Court entered an order accepting the hearing panel’s
recommendations and disbarring Rosenbush. Further, the Supreme Court ordered Rosenbush to
make immediate full restitution to four complainants/clients. The Supreme Court ordered
Rosenbush to turn over any client files within 5 days of the date of the order and entered as
judgments against Mr. Rosenbush the orders of restitution for these four clients/complainants.

Lastly, the Supreme Court ordered Rosenbush to pay to the Board of Professional Responsibility
the costs for the disciplinary proceeding.

Rosenbush’s disciplinary case was held pursuant to Supreme Court Rules 8 and 9. In
Tennessee, disbarred lawyers may after five years apply for reinstatement of their law licenses.
However, to be reinstated, Rosenbush must show by clear and convincing evidence that his
reinstatement will not be detrimental to the integrity and standing of the bar or the administration
of justice or subversive to the public interest.
