KNOXVILLE LAWYER TEMPORARILY SUSPENDED BY SUPREME COURT

By Order of the Supreme Court of Tennessee filed April 22, 2005, John Earl
Rainwater’s license to practice law was temporarily suspended, pursuant to Section 4.3
of Supreme Court Rule 9, upon a finding that Mr. Rainwater failed to respond to a
complaint of misconduct.

The April 22, 2005, Order precludes Mr. Rainwater from accepting any new
cases effective April 22, 2005. Mr. Rainwater may continue to represent existing clients
for thirty days. Mr. Rainwater must cease representing existing clients effective May 23,
2005, upon which date Mr. Rainwater will be prohibited from using any indicia of lawyer,
legal assistant, or law clerk, etc., and from maintaining a presence where the practice of
law is conducted.

The Order filed April 22, 2005, requires Mr. Rainwater to notify by registered or
certified mail all clients being represented in pending matters, as well as co-counsel and
opposing counsel, of the Supreme Court’s order suspending his law license. Section 18
of Supreme Court Rule 9 requires Mr. Rainwater to deliver to all clients any papers or
property to which they are entitled.

Mr. Rainwater may for good cause request dissolution or modification of this
temporary suspension by petition to the Supreme Court. This temporary suspension
remains in effect until dissolution or modification by the Supreme Court.
