The above oornplaint was ï¬led against Cynthia Dayle, an attotney licensedâto practioe
. law in Tennessee, alleging certain acts of misconduct. Pursuant to Supreme Court Rule 9, the
Board of Professional Responsibility considered this matter at its meeting on March 12, 2010.
Complainant paid Respondent at $3,000.00 retainer fee for representation in a contested
divorce ease. Respondent immediately ï¬ledâa Notice of Appearance and provided a copy to;
opposing counsel. Offer tll'eâoourse of the next ï¬ve (5) months; Respondent failed to ï¬le any â
pleadings or send out any correspondence on oehalf of Complainant. On or about March 15,
2008, Respondent received notice from opposing counsel that a Motion for Default had been
filed for failure to ï¬le an Answer to the Complaint Respondent failed to notify Complement
regardlng the Motion for Default for nearly two months; In an effort to avoid an adverse Default
Judgment, Respondent ï¬led an Answer, OounterâComplahtt, Proposed Patenting Plan, and
Motions on behalf of Complement on May_23, 2008.. Complainant subsequently terminated the
attomeyâelient relationship andsougat other counsel for representation. â
