PUBLIC CENSURE

The above oornplaint was filed against Cynthia Dayle, an attotney licensed‘to practioe

. law in Tennessee, alleging certain acts of misconduct. Pursuant to Supreme Court Rule 9, the

Board of Professional Responsibility considered this matter at its meeting on March 12, 2010.

Complainant paid Respondent at $3,000.00 retainer fee for representation in a contested

divorce ease. Respondent immediately filed‘a Notice of Appearance and provided a copy to;

opposing counsel. Offer tll'e‘oourse of the next five (5) months; Respondent failed to file any ‘
pleadings or send out any correspondence on oehalf of Complainant. On or about March 15,

2008, Respondent received notice from opposing counsel that a Motion for Default had been

filed for failure to file an Answer to the Complaint Respondent failed to notify Complement

regardlng the Motion for Default for nearly two months; In an effort to avoid an adverse Default

Judgment, Respondent filed an Answer, Oounter—Complahtt, Proposed Patenting Plan, and

Motions on behalf of Complement on May_23, 2008.. Complainant subsequently terminated the

attomey—elient relationship andsougat other counsel for representation. ‘
