TULLAHOMA LAWYER SUSPENDED

On July 20, 2011, Robert T. Carter, of Tullahoma, Tennessee, was suspended by the Tennessee Supreme
Court for a period of five (5) years with fourteen (14) months being active suspension and the remaining forty-
six (46) months of probated suspension, pursuant to Tennessee Supreme Court Rule 9, Section 8.5. The
Supreme Court imposed the following conditions upon Mr. Carter’s probation of forty-six (46) months: a)
practice monitor approved by the Board shall confer with Mr. Carter weekly, meet with Mr. Carter monthly and
review the status of his cases, fee arrangements and deposits of trust funds and retainers; and b) Mr. Carter’s
agreement to revise his TLAP monitoring agreement.
On April 9, 2009, the Board of Professional Responsibility filed a Petition for Discipline against Mr.
Carter based upon Mr. Carter’s theft from his former law firm. While this Petition for Discipline was pending,
on February 17, 2011, the Supreme Court summarily suspended Mr. Carter based upon his conditional guilty
plea in State v. Carter to felony theft from his former law firm. The board subsequently filed a Final Petition
for Discipline against Mr. Carter based upon his conditional guilty plea in State v. Carter. Mr. Carter’s actions
violate the following Rules of Professional Conduct: 1.15 (safekeeping property) and 8.4 (misconduct).
Mr. Carter was ordered to pay the expenses and costs of the disciplinary proceeding against him,
pursuant to Rule 9, Section 4.7 of the Rules of the Supreme Court, and was ordered to fully comply in all
respects with the requirements and obligations of suspended attorneys as set forth in Rule 9, Section 18 of the
Rules of the Supreme Court.
