JUDGMENT
This case was heard upon the record on appeal from the Chancery Court for
Davidson County, the briefs of the parties, and the argument of counsel. Upon
consideration thereof, this Court holds that substantial and material evidence supports the
Hearing Panelâs findings that James A. Dunlap, Jr. violated Tennessee Rules of
Professional Conduct 3.3, 3.5(a), 8.4(c), and 8.4(d). The Hearing Panelâs decision to
suspend Mr. Dunlap for one year is also supported by substantial and material evidence
and was neither arbitrary nor an abuse of discretion.
In accordance with the opinion filed herein, it is, therefore, ordered and adjudged
that the judgment of the Chancery Court for Davidson County upholding the Hearing
Panelâs decision is affirmed.
The costs of this cause are taxed to James A. Dunlap, Jr., for which execution may
issue if necessary.
