On July 23, 2026, Harold Wayne Graves, an attorney licensed to practice law in Tennessee, received a
Public Censure from the Board of Professional Responsibility of the Tennessee Supreme Court.
Mr. Graves agreed to represent a client in connection with a closed probate matter. The client was a
named beneficiary who requested that Mr. Graves review the court record and other documentation to confirm
that the estate had been properly administered. The fee agreement drafted by Mr. Graves and signed by the client
failed to adequately define the scope of representation. After undertaking the representation, Mr. Graves delayed
taking action for the client and failed to respond to the clientâs communications about the status of the
representation. Following discharge, Mr. Graves failed to respond to the clientâs requests for her file materials
and a refund of her fees.
By these acts, Harold Wayne Graves has violated Rules of Professional Conduct 1.3 (diligence), 1.4
(communication), 1.5(a) (fees), 1.5(b) (scope of representation), 1.15 (safekeeping property and funds), and
1.16(d) (terminating representation) and is hereby Publicly Censured for these violations. The Public Censure
shall be conditioned on Mr. Gravesâs payment of $600.00 in restitution to the client within sixty (60) days of the
date of entry.
A Public Censure is a rebuke and warning to the attorney, but it does not affect the attorneyâs ability to
practice law.
