MCNAIRY COUNTY LAWYER CENSURED
On October 19, 2015, Ross Neal Mitchell, an attorney licensed to practice law in Tennessee, received a
Public Censure from the Board of Professional Responsibility of the Tennessee Supreme Court.
Mr. Mitchell was hired to pursue a legal malpractice action. Mr. Mitchell prepared a complaint and had
the client sign the document. Thereafter, he made multiple misrepresentations to his client, including that he
filed the complaint, that there were court hearings scheduled on three occasions, that mediation was scheduled
on a particular date, and that the lawsuit was successful. Mr. Mitchell has no prior discipline and has made full
and free disclosure of his actions.
By these acts, Mr. Mitchell has violated Rule of Professional Conduct 1.1 (competence), 1.3 (diligence),
1.4 (communication), and 1.16 (terminating representation). Mr. Mitchell further violated Rule 8.4(c)
(dishonesty, misrepresentation) multiple times and is hereby Publicly Censured for this violation.
A Public Censure is a rebuke and warning to the attorney, but it does not affect the attorneyâs ability to
practice law.
