PUBLIC CENSURB

The above complaint was filed against John McConnell Wolfe, Jr., an attorney licensed

to practice law in Tennessee, alleging certain acts of misconduct. Pursuant to Supreme Court

Rule 9, the Board of Professional Responsibility considered these matters at its meeting on

March 9, 2012.

Complainant was injured on the job at a Veterans’ Administration Hospital, and she later

hired Respondent to file a personal injury action. Respondent untimely mailed a notice of claim,

which was beyond the statutory two—year limitation period of federal tort actions. The claim was

denied as untimely. Thereafter, Respondent tmtimely filed a federal onurt lawsuit, which was

beyond the six—month time period for filing after a notice of denial. The federal. action was

dismissed because Respondent failed to comply with the prior statutory deadlines. Respondent

failed to notify Complainant of the denial of claim and the dismissal of the lawsuit. Respondent

failed to rettu'n numerous messages and failed to appear for scheduled appointments.
By the aforementioned facts, John McConnell Wolfe, Jr., has violated Rules of

Professional Conduct 1.3 (Diligence), 14 (Communication), 3.2 (Expediting Litigation), and 8.4

(Misconduct) and is hereby Publicly Censured for this violation
