CHATTANOOGA LAWYER CENSURED
Dana Layne Loftis, a Chattanooga attorney, was publicly censured by the Board of
Professional Responsibility on October 31, 2002, as a consequence of Ms. Loftis having been
found guilty of contempt by the Cour t of Criminal Appeals on May 1, 2002, for willfully failing
to comply with an Order the Court of Criminal Appeals entered January 8, 2002, requiring Ms.
Loftis to file an appellant brief on behalf of her criminal client within fourteen days.
The censure was issued by the Board of Professional Responsibility and there was no
request for a hearing by Ms. Loftis. The Board of Professional Responsibility determined that
Ms. Loftis' conduct adversely reflected upon her fitness to practice law in violation of DR 7-
101(A)(1) and DR 7-106(A) of the Code of Professional Responsibility.
A public censure is a form of public discipline which declares the conduct of the lawyer improper,
but does not limit the lawyer's right to practice law.
