ORDER OF REINSTATEMENT
This matter is before the Court, pursuant to Tenn. Sup. Ct. R. 9, § 30.4(c)(2014),
upon a Petition for Reinstatement filed with the Board of Professional Responsibility on
August 31, 2015, by Petitioner, Mitchell Stanley Givens. Mr. Givens was suspended
from the practice of law by Order of this Court on August 13, 2015, for a period of one
(1) year, with thirty (30) days to be served as an active suspension. Pursuant to Tenn.
Sup. Ct. R. 9, § 14.1(2014), the remainder of the suspension shall be probated subject to
conditions set forth in the Order of Enforcement entered August 13, 2015. A Notice of
Submission was filed by the Chief Disciplinary Counsel indicating the petition is
satisfactory to the Board, and Mr. Givens has satisfied all conditions set forth in the
Order imposing discipline and is eligible for reinstatement.
From all of which the Court grants the Petition for Reinstatement.
IT IS, THEREFORE, ORDERED, ADJUDGED AND DECREED BY THE
COURT THAT:
1. The Petitioner, Mitchell Stanley Givens, is hereby reinstated to the practice
of law in the State of Tennessee pursuant to Tenn. Sup. Ct. R. 9, §30.4(c)(2014) subject
to the following conditions:
(a)During the period of probation, Mr. Givens shall continue to comply with the
recommendations and requirements of Tennessee Lawyers Assistance
Program.
(b)During the period of probation, Mr. Givens shall not engage in professional
misconduct.
2. Mr. Givens shall pay to the Clerk of this Court the costs incurred herein
within ninety (90) days of the entry of this Order, for all of which execution may issue if
necessary.
3. The Board of Professional Responsibility shall cause notice of this
reinstatement to be published as required by Term. Sup. Ct. R. 9, § 28.11 (2014).
