ORDER OF ENFORCEIVIENT

This matter is before the Court upon a Petition for Discipline filed against Fred T.
Hanzelik on April 21, 2011, by the Board of Professional Responsibility (the Board) in
Docket No. 2011—2037—3-SG; upon Fred T. Hanzelik’s Response to Petition for
Discipline filed May 25, 2011; upon the Board’s Supplemental Petition for Discipline
filed January 9, 2012; upon Mr. Hanzelik’s Response filed February 3, 2012', upon the
Board’s Second Supplemental Petition for Discipline filed May 23, 2012; upon Mr.
Hanzelik’s Answer on June 15, 2012; upon Mr. Hanzelik’s Conditional Guilty Plea filed
September 21, 2012; upon the Hearing Panel’s Order of Recommendation of Conditional
Guilty Plea entered on October 1, 2012; upon the Board’s approval of the Conditional
Guilty Plea on October 8, 2012, and upon the entire record in this cause.

From all of which the Court approves the Order of the Hearing Panel and adopts
the Hearing Panel’s Order of Recommendation Approving Conditional Guilty Plea as the
Court’s Order.

By Opinion filed September 27, 2012, this Court previously suspended Mr.
Hanzelik from the practice of law for forty-five (45) days and affirmed the Hearing
Panel’s Judgment and Hamilton County Chancery Court’s Order in Docket No. 132011—
01886~SCnR3—BP.

It is, therefore, ordered, adjudged, and decreed by the Court that:

1. Fred T. Hanzelik is suspended from the practice of law for one year, with
six months actual suspension and the remaining six months served on probation subject to
the terms outlined in Fred T. Hanzelik’s Conditional Guilty Plea:
(a) Mr. Hanzelik will meet monthly with his practice monitor;

(‘0) Mr. Hanzelik will furnish to the practice monitor a list of all clients and
cases currently pending with the following information: (1) the status of each case; (2)
the last date of contact for each client; and (3) a plan of action for each case;

(c) Mr. Hanzelik will be required to immediately contact his practice monitor
in the event that any judge, Opposing counsel, client, or prospective client initiates any
adverse centact or communication with Mr. Hanzelik concerning the status or
development of any case;

(d) The practice monitor will be required to report the status of the monthly
meetings with Mr. Hanzelik to the Board of Professional Responsibility.

2. Mr. Hanzelik also agrees to return $1,000.00 to his former client, Kirk
Lewis.

3. Pursuant to Tenn. Sup. Ct. R. 9 § 18.5, this Order shall be effective ten (10)
days after the date of entry.

4. Pursuant to Tenn. Sup. Ct. R. 9 § 24.3, Mr. Hanzelik shail pay to the Board
of Professional Responsibility the expenses and costs of this matter in the amount of
$5,240.58 at the rate of $500.00 per month and shall pay to the Clerk of this Count the
costs incurred herein, within ninety (90) days of the entry of this Order, for all of which
execution may issue if necessary.

5. The Board of Professional Responsibility shall cause notice of this
discipline to be published as required by Tenn. Sup. Ct. R. 9 § 18.10.
