RELEASE OF INFORMATION
RE: DAVID DWAYNE HARRIS, BPR #32607
CONTACT: EILEEN BURKHALTER SMITH
BOARD OF PROFESSIONAL RESPONSIBILITY
615-361-7500
January 13, 2017
WILLIAMSON COUNTY LAWYER CENSURED
On January 11, 2017, David Dwayne Harris, an attorney licensed to practice law in Tennessee, received
a Public Censure from the Board of Professional Responsibility of the Tennessee Supreme Court.
In two client matters, Mr. Harris failed to respond to multiple requests for information from the clients
over the course of several months. In another matter, Mr. Harris agreed to appeal the denial of a client’s federal
habeas corpus petition. Mr. Harris filed the notice of appeal untimely, and failed to respond to the appellate
court’s show cause order on why the appeal should not be dismissed. In each matter, Mr. Harris’ clients
suffered potential harm.
By these acts, Mr. Harris is in violation of Rules 1.3 (diligence), 1.4 (communication), 1.16 (termination
of representation), 3.2 (expediting litigation), and 8.4(d) (prejudice to the administration of justice) and is
hereby Publicly Censured for these violations
A Public Censure is a rebuke and warning to the attorney, but it does not affect the attorney’s ability to
practice law.
