On June 21, 2011, Mitchell Jeffrey Ferguson of Murfreesboro, Tennessee, was publicly censured and
ordered to pay restitution by the Tennessee Supreme Court.
The Board of Professional Responsibility filed a Petition for Discipline against Mr. Ferguson pursuant to
Rule 9 of the Rules of the Supreme Court of Tennessee. Mr. Ferguson submitted a Conditional Guilty Plea to
the Petition acknowledging violating Tennessee Supreme Court Rule 8, Rules of Professional Conduct 1.3
(diligence); 1.4 (communication); 1.5 (fees); 1.7 (conflict of interest); 1.16 (terminating representation); 8.1
(disciplinary matters), and 8.4 (misconduct). Mr. Ferguson was further ordered to pay $3,280 in restitution to
three (3) former clients and the costs of the disciplinary proceedings.
For these violations, the Supreme Court of Tennessee publicly censured Mitchell Jeffrey Ferguson. A
public censure is a rebuke and warning to the attorney, but it does not affect the attorneyâs ability to practice
law.
