MEMPHIS LAWYER DISBARRED

On June 6, 2008, Thomas Keith McAlexander, of Memphis, Tennessee, was disbarred by Order of the
Tennessee Supreme Court.

The Board of Professional Responsibility filed a Petition for Discipline against Thomas Keith
McAlexander pursuant to Rule 9 of the Rules of the Supreme Court of Tennessee. Thomas Keith McAlexander
violated the Rules of Professional Conduct by falsely representing to a plaintiff’s counsel that he had authority
to settle a hospital negligence claim. Mr. McAlexander made continuous misrepresentations over the course of
two years that the settlement was approved and that the plaintiff would be receiving a monetary settlement. Mr.
McAlexander also failed to self-report his misconduct to the Board after assuring his supervisor and plaintiff’s
counsel that he would do so. Thomas Keith McAlexander is also ordered to pay the costs of the disciplinary
proceedings.

Thomas Keith McAlexander’s actions violate the following Rule(s) of Professional Conduct: 3.1,
Meritorious Claims and Contentions; 3.4, Fairness to Opposing Party and Counsel; 4.1, Truthfulness and
Candor in Statements to Others; 4.4, Respect for the Rights of Third Persons; and 8.4, Misconduct.

Thomas Keith McAlexander must comply with the requirements of Rule 9, § 19 of the Rules of the
Supreme Court should he seek reinstatement of his Tennessee law license and he may not resume practice until
reinstated by further order of this Court. He must further comply with Rule 9, §18 of the Rules of Supreme
Court regarding the obligations and responsibilities of disbarred attorneys.
