MEMPHIS LAWYER PUBLICLY CENSURED

On November 3, 2006, the Board of Professional Responsibility issued a Public
Censure to Mark D. Talley of Memphis, Tennessee. He did not request a hearing. Talley failed
to notify his client of his suspension and his client could not contact him in violation of Section
18 of Tennessee Supreme Court Rule 9 and 8.4(a)(d) of the Tennessee Rules of Professional
Conduct. The Board of Professional Responsibility determined that Talley should be censured
for the ethics violations as summarized above, conditioned upon Talley’s refund to his client in
the amount of $1,000. In the event Talley fails to refund the $1,000 to his client, then this
censure shall be vacated and the matter shall be determined by a formal proceeding.

A public censure is a form of discipline that declares the conduct of the lawyer
improper but does not limit the lawyer’s right to practice law.
