CHATTANOOGA LAWYER CENSURED BY SUPREME COURT

By Order of the Tennessee Supreme Court entered August 12, 2005, William A. Lockett,
a Chattanooga attorney, was publicly censured. A Petition for Discipline had been filed against
Mr. Lockett by the Board of Professional Responsibility on September 7, 2004. On July 18,
2005, Mr. Lockett entered into a Conditional Plea of Guilty with the Board of Professional
Responsibility to resolve the Petition for Discipline in exchange for the Public Censure.

In one matter, Mr. Lockett made a misrepresentation regarding the condition of his
mother's health to adversary counsel and to the court in order to obtain a continuance of a trial.
Mr. Lockett immediately reported the misrepresentation to the adversary counsel and to the court
and paid fees to adversary counsel as ordered by the court. In another matter, Mr. Lockett made
a misrepresentation to adversary counsel's office in order to secure postponement of party
depositions and did not pursue the representation with competence and diligence.

Mr. Lockett admitted violating DR 1-102(A)(1)(4)(5)(6), DR 7-102(A)(3)(5)(8), DR 7-
106(C)(5)(6)(7) of the Code of Professional Responsibility and Rules of Professional Conduct
1.1, 1.3, 1.4, 3.2, 4.1(a), and 8.4(a)(c)(d)(e).

A Public Censure is a form of public discipline which declares the conduct of the lawyer
improper but does not limit the lawyer's right to practice.
