KNOXVILLE LAWYER SUMMARILY AND TEMPORARILY SUSPENDED
On May 30, 2002, the Supreme Court of Tennessee issued an order summarily
and temporarily suspending Millard Dale Millerâs license to practice law, upon finding
that Mr. Miller failed to respond to the request of the Board of Professional
Responsibility for additional information necessary to complete his response to a
complaint of misconduct against him. Section 4.3 of Supreme Court Rule 9 provides for
immediate suspension of an attorneyâs license to practice law in cases of a failure to
respond to a summary of complaint. Disciplinary Counsel filed a petition with the
Supreme Court alleging that Mr. Miller failed to respond to a request for additional
information necessary to complete his response to the complaint of misconduct against
him.
The May 30, 2002, order precludes Mr. Miller from accepting any new cases. Mr.
Miller may continue to represent existing clients for thirty days. Mr. Miller must cease
representing existing clients effective June 29, 2002. After June 29, 2002, Mr. Miller
shall not use any indicia of lawyer, legal assistant, or law clerk, etc., nor maintain a
presence where the practice of law is conducted.
The order requires Mr. Miller to notify by registered or certified mail all clients
being represented in pending matters, as well as co-counsel and opposing counsel, of
the Supreme Courtâs order suspending his law license. Section 18 of Supreme Court
Rule 9 requires Mr. Miller to deliver to all clients any papers or property to which they
are entitled.
This suspension remains in effect until dissolution or modification by the
Supreme Court. Mr. Miller may for good cause request dissolution or modification of the
suspension by petition to the Supreme Court.
