ORDER REMOVING DISABILITY INACTIVE STATUS
This matter is before the Court, pursuant to Tenn. Sup. Ct. R. 9, § 27.7, upon a
Petition for Reinstatement Pursuant to Tenn. Sup. Ct. R. 9, Section 27.7, filed on
February 5, 2016. Ms. Preston's law license was transferred to disability inactive status
by Order of this Court on May 29, 2015.
The Board has filed a response stating that there is no objection to removing Ms.
Preston from disability inactive status; however, the Board notes that at the time Ms.
Preston was placed on disability inactive status, there were three (3) open investigative
files pending with the Board of Professional Responsibility, and a Petition for Discipline
containing one complaint.
IT IS, THEREFORE, CONSIDERED, ORDERED, ADJUDGED AND
DECREED BY THE COURT THAT:
1. Ashley Denise Preston shall be removed from disability inactive status.
2. Ms. Preston shall not be returned to active status until resolution of any
pending disciplinary proceedings, pursuant to Tenn. Sup. Ct. R. 9, § 27.7(c). Ms. Preston
must also satisfy any outstanding continuing legal education obligations prior to any
subsequent reinstatement to active status.
3. Pursuant to Tenn. Sup. Ct. R. 9, § 31.3, Ms. Preston shall pay to the Board
of Professional Responsibility the expenses and costs of this matter in the amount of
$80.00 and, in addition, shall pay to the Clerk of this Court the costs incurred herein,
within ninety (90) days of the entry of this Order, for all of which execution may issue if
necessary.
