NASHVILLE ATTORNEY SUSPENDED

Cynthia N. Asbury, a Nashville attorney, was suspended from the practice of law by order of the
Tennessee Supreme Court entered on August 30, 2002. The Court found that Asbury poses a
substantial threat of irreparable harm to the public based on a petition and affidavits filed by the
Board of Professional Responsibility.

The suspension was issued pursuant to Section 4.3 of Tennessee Supreme Court Rule 9.
Attorneys suspended under Section 4.3 are precluded from accepting new clients from the initial
suspension date (August 30, 2002) until reinstated.

Representation of present clients is permitted for a period of thirty days. (until September 30,
2002.) After September 30, 2002, Asbury may not represent any clients and she is not allowed
to use any indicia of lawyer, law clerk or legal assistant, nor maintain a presence where the
practice of law is conducted.

Asbury is required to notify by registered or certified mail, return receipt requested, all clients
being represented in pending matters, all co-counsel and opposing counsel of the issuance and
effect of the suspension order. She is required to deliver to clients any papers or property which
they are entitled to receive.

This suspension shall remain in effect until it is dissolved or amended by the Supreme Court.
Ms. Asbury has the right to make application to the Supreme Court to modify or dissolve the
suspension.
