KINGSTON LAWYER CENSURED
Spence R. Bruner, a Kingston attorney, received a Public Censure from the Board of
Professional Responsibility on September 9, 2005.
In File No. 26921c-2-tc, Mr. Bruner failed to provide Complainant with timely notice of
the resolution of his appeal before the Court of Criminal Appeals and violated Supreme Court
Rule 14 by failing to file a timely motion to withdraw from Complainantâs case.
In File No. 27359-2-tc, Mr. Bruner made a unilateral decision not to cross-examine an
adverse witness without consulting his client, and failed to pursue appeals desired by his client
when he had not been relieved by the court from his representation of his client, in violation of
Supreme Court Rules 13(e)(5) and 14.
In File No. 27613-2-tc, Mr. Bruner failed to adequately respond to his clientsâ requests
for information, failed to take requested and necessary action on their case, and failed to appear
at a hearing, sending his secretary to notify the court and his clients that he was ill and could not
be there, to the courtâs displeasure.
In several instances in investigation of these complaints, Mr. Bruner did not respond to
additional requests for information from Disciplinary Counsel.
By the aforementioned facts, Spence Roberts Bruner has violated Rules 1.1, 1.2, 1.3, 1.4,
1.16, 3.2, 3.4(c), 8.1(b), and 8.4(a)(d) of the Rules of Professional Conduct and is hereby
Publicly Censured for that violation.
