BOARD OF PROFESSIONAL RESPONSIBILITY
September 10, 2002
NASHVILLE LAWYER REINSTATED
Phillip A. Purcell, a Nashville lawyer, has been reinstated to the practice of law by order of the
Tennessee Supreme Court entered on August 23, 2002. Purcell was suspended for a fixed period
of one year on May 17, 2000, and for an indeterminate period until restitution was made and costs
were paid.
A hearing panel of the Board of Professional Responsibility found that Purcell had fully complied
with the conditions regarding restitution and costs and that he should be reinstated. The Supreme
Court accepted and approved the recommendation of the hearing panel.
Purcell was suspended in 2000 for misappropriating funds from the law firm he worked for. The
hearing panel found that Mr. Purcell demonstrated by clear and convincing e vidence that he has
the moral qualifications, competency and learning in the law required for readmission to the
practice of law. The hearing panel found that reinstatement of Purcell would not be detrimental to
the integrity and standing of the bar or administration of justice nor subversive to the public
interest.
During the period of disciplinary suspension, Purcell was also placed on administrative
suspension for failure to report continuing legal education credits. Reinstatement on the
disciplinary matter does not affect the administrative suspension.
