ORDER OF ENFORCEMENT
This matter is before the Court upon a Petition for Discipline filed against Loniel
Greene, Jr., on September 14, 2016; upon an Answer to Petition for Discipline filed by
Mr. Greene on January 20, 2017; upon an Amended Petition for Discipline filed on May
23, 2017; upon an Answer to Amended Petition for Discipline filed on July 7, 2017; upon
a hearing on July 13, 2017; upon the Board of Professional Responsibilityâs Application
for Assessment of Costs filed on August 9, 2017, upon the Findings of Fact, Conclusions
of Law and Judgment entered on August 28, 2017; upon service of the Findings of Fact,
Conclusions of Law and Judgment on Mr. Greene by the Executive Secretary of the
Board on August 28, 2017; upon consideration and approval by the Board on September
8, 2017; upon expiration of the appeal period with no appeal taken; and upon the entire
record in this cause.
From all of which the Court approves the Judgment of the Hearing Panel and
adopts the Hearing Panelâs Judgment recommending a disbarment.
On August 17, 2017, Mr. Greene was administratively suspended by this Court
pursuant to Tenn. Sup. Ct. R. 21, § 7 (ADM No. 2017-00005). To date, Mr. Greene has
not requested, nor been granted reinstatement, from this suspension.
IT IS, THEREFORE, CONSIDERED, ORDERED, ADJUDGED AND
DECREED BY THE COURT THAT:
(1) Loniel Greene, Jr., is disbarred, pursuant to Tenn. Sup. Ct. R. 9, § 12.1.
(2) Prior to seeking reinstatement, Mr. Greene must meet all CLE
requirements; have remitted all outstanding registration fees and outstanding professional
privilege taxes, including those due from the date of this disbarment until the date of
reinstatement; and have remitted all court costs and Board costs in this matter.
(3) Additionally, Mr. Greene shall comply in all aspects with Tenn. Sup. Ct. R.
9, §§ 28 and 30.4, regarding the obligations and responsibilities of disbarred attorneys
and the procedure for reinstatement.
(4) Further, the Order of Administrative Suspension entered on August 17,
2017, in ADM No. 2017-00005 remains in effect.
(5) Pursuant to Tenn. Sup. Ct. R. 9, § 28.1, this Order shall be effective upon
entry.
(6) Pursuant to Tenn. Sup. Ct. R. 9, § 31.3(d), Mr. Greene shall pay to the
Board of Professional Responsibility the expenses and costs of this matter in the amount
of $1,671.73 and shall pay to the Clerk of this Court the costs incurred herein, within
ninety (90) days of the entry of this Order, for all of which execution may issue if
necessary.
(7) The Board of Professional Responsibility shall cause notice of this
discipline to be published as required by Tenn. Sup. Ct. R. § 28.11.
