ORDER TRANSFERRING ATTORNEY TO
DISABILITY INACTIVE STATUS

This matter is before the Court upon a petition to transfer Katherine Evett Smith,
to disability inactive status filed by the Tennessee Board of Professional Responsibility
pursuant to Tenn. Sup. Ct. R.9, § 27.4.

Upon due consideration of documentation from Ms. Smith's medical care provider
submitted by Ms. Smith, the Court concludes that Katherine Evett Smith is currently
incapacitated from continuing the practice oflaw.

IT IS, THEREFORE, CONSIDERED, ORDERED, ADJUDGED AND
DECREED BY THE COURT THAT:

1. The law license of Katherine Evett Smith shall be transferred to disability
inactive status for an indefinite period of time and until further orders of the Supreme
Court.

2. The Petition for Discipline, Supplemental Petition for Discipline and
Second Supplemental Petition for Discipline proceedings, Docket No. 2016-2557-9-WM,
are suspended indefinitely until such time as Ms. Smith is removed from disability
inactive status.

3. Ms. Smith shall be allowed to petition for reinstatement to active status
pursuant to Tenn. Sup. Ct. R.9,§ 27.7.

4. The Board shall publish notice ofthis transfer pursuant to Tenn. Sup. Ct. R.
9,§§ 27.5 and 28.11.
5. Pursuant to Tenn. Sup. Ct. R. 9, § 32.4, documents other than this Order
relating to Ms. Smith's disability proceeding shall not be public records and shall be kept
confidential.
