LAWYER CENSURED BY SUPREME COURT
By Order of the Supreme Court of Tennessee entered August 19, 2008, Charles Craig Morrow, an
attorney, was publicly censured by the Board of Professional Responsibility of the Supreme Court of
Tennessee.
In one matter, the Respondent personally guaranteed a bond required for Respondentâs client to qualify
to be appointed as executor of an estate. When the Respondentâs client discharged the Respondent as counsel,
the Respondent filed a motion to withdraw and a motion to remove Respondentâs client as executor of the
estate. The Respondent filed a motion against the interest of his client, in violation of RPC 1.7(b).
In another matter, the Respondent filed a petition on behalf of the wardâs son to appoint the wardâs son
as conservator of the ward. The ward joined the petition stating, under oath, that she needed a conservator and
wanted her son to be her conservator. Another of the wardâs sons subsequently filed a petition to be appointed
conservator, to which Respondent filed an Answer on behalf of the ward. An attorney ad litem was
subsequently appointed for the ward. No written waiver of conflict was obtained to permit the Respondent to
represent the ward and the wardâs son, who had conflicting or potentially conflicting interest. The
Respondentâs actions were in violation of RPC 1.7.
For these violations, the Board of Professional Responsibility publicly censures Charles Craig Morrow.
A public censure is a rebuke and warning to the attorney, but it does not limit the attorneyâs ability to practice
law.
