CHATTANOOGA LAWYER CENSURED

On December 22, 2009, Tabitha Finch of Chattanooga, Tennessee, was publicly censured by the
Tennessee Supreme Court.

The Board of Professional Responsibility filed a Petition for Discipline against Ms. Finch pursuant to
Rule 9 of the Rules of the Supreme Court of Tennessee. Ms. Finch submitted a Conditional Guilty Plea that
was approved by the Hearing Panel, the Board and the Supreme Court. Ms. Finch violated the Rules of
Professional Conduct by failing to diligently represent and communicate with her clients, by failing to properly
terminate representations of her clients and by failing to adequately respond to Disciplinary Counsel for the
Board of Professional Responsibility. Ms. Finch’s actions violated the following Rules of Professional
Conduct: 1.1 (Competence), 1.3 (Diligence), 1.4 (Communication), 1.5 (Fees), 1.16 (Declining and
Terminating Representation), 8.1(b) (Bar Admission and Disciplinary Matters), and 8.4 (a) (Misconduct). Ms.
Finch was further ordered to pay the costs of the disciplinary proceedings.

For these violations, the Supreme Court of Tennessee publicly censured Tabitha Finch. A public
censure is a rebuke and warning to the attorney, but it does not affect the attorney’s ability to practice law.
