PUBLIC CENSURE
The above complaint was ï¬led against Arthur Wayne Henry, #9484, an attorney licensed
to practice law in Tennessee, alleging certain acts ofmisconduct. Pursuant to Tenn. Sup. Ct. R. 9,
the Board of Professional Responsibility considered these matters at its meeting on December 1 1,
2015.
In 2012, Mr. Henry was hired to represent a client in a tort lawsuit for damages. After Mr.
Henry ï¬led a notice of appearance on July 20, 2012, the next action that occurred in the case was
a substitution of opposing counsel over a year later in August of 2013. The only other action taken
by Mr. Henry was to depose the defendant in December of 2013. Based on Mr. Henryâs inaction,
the defendants moved to dismiss for failure to prosecute in January cf2015. Mr. Henry did not ï¬le
a response to the motion to dismiss and failed to appear when the motion was heard in March of
2015.
By the aforementioned acts, Arthur Wayne Henry has violated Rules of Professional
Conduct 1.1 (competence), 1.3 (diligence), 1.4 (communication), and 3.2 (expediting litigation)
and is hereby Publicly Censured for these violations.
