PUBLIC CENSURE
The above complaint was ï¬led against James Gregory King, #17439, an attorney licensed
to practice law in fennesscc, alleging certain acts of misconduct. Pursuant to Tenn. Sup. Ct. R.
9, the Board of Professional Responsibility considered these matters at its meeting on September
14, 2018.
In the representation of a client in a domestic relations proceeding, Mr. King failed to
take proper action to comply with a scheduling order, which led to the dismissal of the clientâs
petition, Prior to the hearing on the motion to dismiss, Mr. King made misleading statements to
his client about the nature and signiï¬cance of the motion and hearing. Mr. King also accepted a
refundable fee from a relative of the client without the clientâs knowledge and consent and failed
to deposit this fee into his escrow account.
By these acts, Mr. King has violated Rules of Professional Conduct 1.1 (competence), 1.3
(diligence), 1.4(a) (communication), 1.8(1) (accepting fees or direction from a third party),
1.15(o) (safeguarding client funds), and 3.2 (expediting litigation), and is hereby Publicly
Censored for these violations. Additionally, as a condition ol'tho Public Consure, Mr. King slmll
rcï¬md $2,500.00 in attorney fees to the relative of the client within sixty ((30) days of issuance of
this Public Consux'c.
