DAVIDSON COUNTY LAWYER CENSURED

On August 3, 2010, Thomas Howard Miller, an attorney licensed to practice law in Tennessee,
received a Public Censure from the Board of Professional Responsibility of the Tennessee Supreme Court.

Mr. Miller represented a client in a post-divorce custody modification proceeding. A hearing was
held June 24, 2008, and the court ordered a change in primary custody to Mr. Miller’s client. Mr. Miller
failed to submit a final order in the matter to memorialize the court’s decision. Mr. Miller’s client
contacted him several times to get a status on when the order would be entered with the court, but Mr.
Miller failed to respond to his client’s calls. Mr. Miller did not enter a final order in his client’s case until
March 1, 2010. Mr. Miller’s conduct prejudiced his client’s ability to enforce the child support obligation
of her former spouse.

By these acts, Thomas Howard Miller has violated Rules of Professional Conduct 1.3 (diligence),
1.4 (communicate), 3.4(c) (knowingly disobeying an obligation under the rules of court), and 8.4(d)
(engaging in conduct prejudice to the administration of justice), and is hereby Publicly Censured for these
violations. A Public Censure is a rebuke and warning to the attorney, but it does not affect the attorney’s
ability to practice law.
