PUBLIC CENSURE
The above complaint was filed against Carrie Watson Gesawey, formerly an attorney
licensed to practice law in Tennessee, alleging certain acts ofmrleeonduet. Pursuant to Tenn. Sup.
Ct. R. 9, the Board of Professional Responsibility considered these matters at its meeting on
Decemhter l I, 2015.
Ms. Gasaway accepted ï¬om a client a $5,000 nonreï¬indable retainer, with $2.50 designated
for trust. Ms. Gasaway did no Work on the civil matter for two years, and then defended two
depositions. Ms. Gasaway provided no explanation for her use of the funds held in trust. In
another matter, Ms. Gaseway accepted $39500 item a client and did no work, and she
failed to
respond to requests for mfonnation from the client. Ms. Gasawey has failed to respond to these
disciplinary complaints.
By the aforementioned acts, Ms. Gesaway has violated R111 es of Professional Conduct
1.3
(diligence), 1.4 (communication), 1.5 (fees), 1.15 (eafekeeping ï¬mds),
1.16 (temï¬natnig
representation), 3.2 (expediting litigation), 8.1 (disciplineiy matters) and 8.4
(ï¬rejudice to the
administration of josï¬ce). Ms. Gasaway is hereby Publicly Censored for these violatio
ns.
Additionally, within ninety (90) days, Ms. Gasaway shaï¬ pay restitution to the ï¬rst client 111 an
amount of $250, and pay restitution to the second client in an amount of $3,500, and provide proof
of such payment to Disciplinary Ccunscl.
