NASHVILLE ATTORNEY CENSURED
On May 7, 2007, Penny Harrington, of Nashville, Tennessee, received a public censure from the Board
of Professional Responsibility. Harrington was given notice of the censure and did not request a hearing.
Harrington represented her client, the father of a minor child, in General Sessions and Juvenile Court
for Davidson County, Tennessee. On February 13, 2006, Harrington filed a complaint with the Metro Nashville
Police Departmentâs Department of Professional Accountability against the husband of the opposing party, the
Complainant, alleging that the Complainant abused his authority as an off-duty police officer and abused the
intent of the uniform by appearing numerous times in Juvenile Court in uniform while off duty. The Metro
Police Departmentâs investigation found Harringtonâs allegations of the Complainantâs intimidation to be false
and untrue and Harringtonâs complaint unfounded. Harringtonâs statements in her complaint filed with the
Metro Police Departmentâs Department of Professional Accountability violate Rules 3.1; 3.4(b), and 8.4(a)(c)
of the Tennessee Rules of Professional Conduct and for these violations the Board publicly censures
Harrington. The censure declares Harringtonâs actions to be unethical conduct but does not limit her right to
practice law.
