TULLAHOMA LAWYER CENSURED
On April 28, 2011, Robert Thomas Carter, an attorney licensed to practice law in Tennessee, received a
Public Censure from the Board of Professional Responsibility of the Tennessee Supreme Court.
Mr. Carter appealed a clientâs sentence in a criminal case. The Court of Criminal Appeals affirmed the
clientâs sentence based upon Mr. Carterâs failure to include the sentencing hearing transcript. Mr. Carter failed
to advise his client of the necessity of having a court reporter present for the sentencing hearing. Mr. Carterâs
actions violated Rules of Professional Conduct 1.1 (competence), 1.3 (diligence), 1.4 (communication and 8.4
(misconduct).
